You can conveniently order a wide range of items including prepared meals, beverages, groceries, and other non-food products (groceries & medicines). Some items, such as pharmaceuticals, may be subject to specific purchase regulations.

While Click To Food facilitates the ordering process, we do not engage in the sale or production of goods. It is the responsibility of the Merchants to comply with local laws and standards regarding their products and services. Users should verify the quality and suitability of items from Merchants directly, as Click To Food does not independently verify these offerings. If you have dietary restrictions or allergies, please contact the Merchant prior to placing your order.

We may enforce limitations on the sale of certain products based on legal requirements but do not guarantee the quality or compliance of Merchant products. Click To Food does not accept liability for issues arising from goods or services provided by Merchants. Users are responsible for ensuring accurate delivery addresses; Click To Food is not liable for delivery failures resulting from inaccurate address details. Merchants handle order preparation and delivery, and although they strive to meet delivery schedules, delays may occur due to unforeseen circumstances. We will notify you promptly of any significant delays.

3. Our Mission

Click To Food collaborates with a variety of restaurants ("Partner Restaurants") to offer efficient delivery services. When you place an order with a Partner Restaurant through our platform, Click To Food acts as an intermediary to facilitate your order and ensure a seamless experience. Depending on your preference, your order may be delivered by Click To Food or directly by the Partner Restaurant. Some Partner Restaurants may be affiliated with Click To Food or owned by us.

4. Service Availability

Each Partner Restaurant has its own designated delivery area, which can vary based on factors like weather conditions or service demand to ensure optimal delivery of items. The operating hours of our Partner Restaurants determine the availability of our service and the selection of restaurants from which you can order. If you attempt to place an order outside of a restaurant's delivery area or operating hours, or if the platform is unavailable for any reason, you will be notified that ordering is not possible.

5. User Account

To access certain features of our Services, you may need to register for an account. When registering and using Click To Food's platform, you must provide accurate, up-to-date, and complete information. It's your responsibility to keep this information accurate and to monitor your account to prevent unauthorised use, especially by minors.

You are solely responsible for all activities that occur under your account or password. You agree not to share your account credentials with others or transfer your account to anyone else. If you suspect unauthorised access to your account, please notify Click To Food immediately. While we strive to protect your account, Click To Food cannot be held liable for losses or damages resulting from unauthorised use of your account, except where required by applicable laws.

Click To Food reserves the right to suspend or terminate your account and refuse current or future use of our Services if we suspect that the information provided is inaccurate, incomplete, or if there are reasonable grounds to do so. Additionally, we may allow or require the use of a single set of login details for accessing Click To Food services. If you have been previously removed from our platform or banned from using our Services, you agree not to create a new account.

By submitting User Content, you grant Click To Food a perpetual, irrevocable, transferable, royalty-free, non-exclusive, worldwide licence to use, modify, publish, distribute, and create derivative works from your User Content for our business purposes. This includes the right to attribute your User Content to you using your username, first name and last initial, and profile photo (if available), without obligation to notify or seek approval from you. Please note that this licence continues even if you stop using our Services.

Click To Food reserves the right to remove or disable access to any User Content, suspend or terminate your account, or take other actions if your User Content violates this Agreement or our community guidelines.

7.1. Feedback

If you provide suggestions, ideas, or proposals (“Feedback”) to Click To Food through our feedback channels, you do so at your own risk. We have no obligation to keep your Feedback confidential. By submitting Feedback, you grant Click To Food a perpetual, irrevocable, transferable, royalty-free, non-exclusive, worldwide license to use, modify, publish, distribute, and create derivative works from your Feedback.

When you rate or review Merchants or other businesses through Click To Food, including through text, photos, images, audio, or videos (“Ratings” and “Reviews”), you acknowledge that:

a. Your Ratings and Reviews are based on your personal experience with the Merchant or business.

b. You have no affiliation with the Merchant or business you are reviewing that could influence your review.

c. You are not receiving compensation or benefits in exchange for your Rating or Review.

d. Your Ratings and Reviews comply with our terms and guidelines, including not violating any laws or regulations.

Click To Food may decide not to publish or display your Rating or Review for any reason at our discretion. If we determine that a Rating or Review undermines the integrity of our ratings system or violates our terms, we may remove it without notice.

By using our Services, you agree to these terms regarding User Content, Feedback, and Ratings and Reviews.

8. Electronic Records

When you create an account with Click To Food or use our Technology and Services, you agree to the use of electronic records. This means that all terms and conditions, agreements, notices, disclosures, and other communications we provide to you electronically fulfil any legal requirement that such communications be in writing. To access and retain a copy of this Agreement, you will need (a) a device such as a computer or mobile phone with Internet access, and (b) either a printer or storage space on your device.

9. Order Placement and Confirmation

a. Placing an Order: When you place an order through Click To Food, it must be accepted either by us or the Partner Restaurant. Once your order is accepted, you will receive a confirmation notice, establishing a contract for the delivery of the ordered items.

b. Payment Responsibility: You are responsible for paying for all items and associated delivery charges ordered through your account, even if the items are ordered for someone else.

c. Minimum Order Value: Partner Restaurants may have a minimum order value, which will be displayed in the app.

d. Item Availability: All items are subject to availability. If you have allergies, please contact the Partner Restaurant directly before placing your order, as Click To Food cannot guarantee that items will be allergen-free.

10. Order Cancellation and Refunds

a. Food Orders: Once a food order has been accepted by the Vendor, it cannot be canceled by the customer unless there is a fault by Click To Food or the Vendor. If delivery fails due to thecustomer's actions or inactions, the order will be canceled without a refund.

b. Refund Eligibility: If you are eligible for a refund, it will be credited to your Click To Food account.

c. Non-Food Items: Cancellations, returns, and refunds for non-food items will adhere to UAE consumer protection laws. Non-food items include groceries, health and beauty products.

11. Delivery Guidelines

At Click To Food, we strive to ensure a seamless delivery experience for our customers. Here’s what you need to know about our delivery options, handling of delays, ensuring accurate delivery, and what to do in case of failed delivery situations.

a. Immediate and Scheduled Delivery Options

When placing your order with Click To Food, you have the flexibility to choose between immediate and scheduled delivery options.

For immediate delivery, upon confirming your order, we provide you with an estimated delivery window. This allows us to deliver your items swiftly. It’s important that you are available immediately after placing your order to receive your items promptly.

If you prefer scheduled delivery, you can select a specific timeframe that suits your schedule. Please be prepared to receive your order starting ten minutes before the scheduled time and remain available up to ten minutes after to accommodate any minor delays that may occur.

b. Handling Delays

We understand that external factors such as traffic congestion or adverse weather conditions may occasionally impact delivery times. If your delivery is more than 20 minutes late without prior notification, we are committed to resolving the issue promptly. However, delays caused by incorrect delivery details or your unavailability may affect our ability to rectify the situation as effectively.

To ensure successful delivery, please provide accurate delivery details including your address and pin code. If you need to change the delivery address, you may do so before the driver departs, provided the new location falls within the same delivery zone. Once the order preparation has commenced or the driver is en route, any address changes may result in full charges being applied.

d. Failed Delivery Situations

In the event of a failed delivery due to reasons such as unresponsiveness at the delivery location, you may incur charges. It is your responsibility to ensure that you are available and accessible to receive your delivery at the specified location to avoid any complications.

12. Resolving Order Issues

a. Ensuring Quality and Satisfaction: When placing an order through Click To Food, you are entitled to receive items that align with their descriptions and meet your expectations in terms of quality. Should you encounter any discrepancies, it's important to notify us promptly.

b. Communication and Evidence: To facilitate resolution, we may request visual evidence such as a photo of the issue. This helps us understand the problem better and enables us to take appropriate action.

c. Resolution Process: Depending on the nature of the issue, we will provide either a refund or credit for the affected items and any associated delivery charges, particularly if the entire order was impacted. Our decisions are guided by a careful consideration of factors such as order specifics, your account history, delivery circumstances, and insights from the Partner Restaurant.

13. Policy on Order Cancellations and Refunds

a. Cancellation Guidelines: Once a food order has been accepted by the vendor, it typically cannot be cancelled or refunded unless there was an error on our part or by the vendor themselves. This policy ensures clarity and fairness in our transactions.

b. Non-Delivery Situations: In cases where we are unable to fulfill an order due to actions on the customer's part, such as incorrect delivery details or unavailability at the specified location, the order will be cancelled without a refund.

c. Refund Procedures: Refunds for cancelled orders are usually credited to your Click To Food account. If preferred, we can also process refunds back to the original payment method within a reasonable timeframe, typically 7-14 business days.

d. Non-Food Items Policy: For non-food items, including groceries and health products, our cancellation and refund policies adhere strictly to local consumer protection laws. This ensures that all customers are treated fairly and in accordance with relevant regulations.

14. Delivery Terms for Click To Food

a. Delivery Coverage: Click To Food offers delivery services that vary depending on your location. By entering your address on our Platform, you can view available vendors. Please note that delivery areas may change due to factors such as weather conditions, traffic, and other logistical considerations.

b. Estimated Delivery Time: Once you place an order, Click To Food will deliver it to the address you specify. While we provide an estimated delivery time, please understand that actual delivery times may vary due to factors beyond our control. It's important to ensure someone is available to receive the order at the designated location.

c. Failed Delivery Attempts: If Click To Food is unable to complete a delivery due to reasons attributable to you (e. g., no one available to accept the delivery, inability to contact you despite attempts, or lack of access to the delivery location), we will notify you via in-app call, message, or email. In such cases, Click To Food reserves the right to cancel the order without issuing a refund.

d. Customer Support: Should your order encounter issues such as incorrect items, defects, or missing items, please contact our customer support via the in-app chat immediately. We may request additional information or photos to assess the situation. If we determine that the order does not meet satisfactory standards, we will provide appropriate compensation.

e. Delayed Orders: If your order experiences a significant delay, please reach out to our customer support via the in-app chat. We may request further details to investigate the delay. Should the delay be deemed substantial, we will compensate you accordingly for the inconvenience caused.

f. Contactless Option: For certain items, Click To Food offers contactless delivery as an option. It's important to note that once the delivery is completed, Click To Food assumes no liability for theft, damage, or deterioration of goods thereafter.

15. Payment Terms and Methods

Upon confirming your order through Click To Food, you enter into a direct agreement with the chosen restaurant. For cash payments, you will pay the restaurant directly when your order is delivered. Click To Food does not handle any cash transactions directly. For online payments, these are processed through your selected payment service provider, which collaborates with Click To Food to facilitate the transaction.

All prices displayed on our platform are in the local currency and may differ from prices available at the restaurant or other sources. Before completing your order, any additional charges, such as delivery fees, will be clearly shown. We offer various payment options on the platform, giving you flexibility in choosing how to pay. Click To Food may occasionally update or remove certain payment methods to ensure the best service.

It's essential to ensure that your chosen payment method has adequate funds to cover your purchase. Click To Food takes responsibility for handling payments, processing refunds, and resolving disputes as fairly and efficiently as possible, all in accordance with our terms and conditions.

16. Authority of Click To Food

Click To Food retains the right to temporarily halt or completely stop its services at any time, without being liable to users or third parties. Users are responsible for managing their own usernames and passwords, though Click To Food may impose restrictions on password changes when necessary. We do not guarantee that our services will always be timely, secure, or uninterrupted, nor do we promise that they will meet all user expectations. Click To Food reserves the right to back up and delete user files and messages, while maintaining ownership and copyright over theplatform's content. The availability of products depends on current menu offerings, and we are not responsible for any items that are out of stock.

User-generated content on our platform may be reposted or distributed by Click To Food without entitling users to royalties. We reserve the right to correct any pricing or product specification errors by cancelling orders if required. Users might be transitioned to different platforms, with Click To Food not being responsible for the content on those platforms. The nature of our services may change, potentially requiring users to create accounts or make payments, and the platform may become temporarily unavailable for maintenance without prior notice.

17. Termination of Agreement

Click To Food retains the authority to terminate, suspend, or delete your account and restrict access to our platform and delivery services at any time, for any reason. This action can be taken in response to violations of our terms of service or if your activities are deemed inappropriate or harmful to our platform.

Before taking such actions, we aim to provide you with an opportunity to explain your side of the situation, allowing for a fair assessment. However, in some instances where immediate action is required, we may proceed without prior notice to ensure the integrity and safety of our services.

Upon termination or suspension, all rights granted to you under this agreement will cease immediately, and you must stop all use of our services. Any pending deliveries or transactions will also be cancelled, and any outstanding balances may become due immediately. Click To Food is not liable for any damages or losses resulting from the termination or suspension of your account.

We emphasise maintaining a respectful and safe environment for all users. Therefore, we take breaches of our terms seriously and act to uphold the standards and integrity of our community. Should your account be terminated or suspended, you may reach out to our support team to seek further clarification or appeal the decision, though reinstatement of access remains at our sole discretion.
